Welcome to Konstrakt! These Terms of Service ("Terms") govern your use of the Konstrakt website, mobile applications, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By creating an account or accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Konstrakt ("we," "us," or "our").

2. Description of Service

Konstrakt is a digital platform designed to connect contractors, construction companies, and skilled workers in the construction industry. We provide tools for project management, worker matching, and job finding.

Disclaimer: Konstrakt acts as a facilitator and venue for connecting users. We are not a construction company, employment agency, or employer of the workers found through the Service. We do not guarantee the quality, safety, or legality of the jobs or the qualifications of the workers.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you have the right, authority, and capacity to enter into this agreement and to abide by all of the terms and conditions set forth herein.

4. User Accounts

To access certain features of the Service, you may be required to register for an account.

  • Accuracy: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • Security: You are responsible for safeguarding your password. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account, whether or not you have authorized such activities or actions.
  • Notification: You must immediately notify us of any unauthorized use of your account.

5. User Conduct

You agree not to engage in any of the following prohibited activities:

  1. Violating Laws: Using the Service for any illegal purpose or in violation of any local, state, national, or international law, including but not limited to labor laws and construction regulations of the Philippines.
  2. False Information: Posting false, misleading, or deceptive content, including fake job postings or falsified worker credentials.
  3. Harassment: Harassing, threatening, or defrauding other users.
  4. Interference: Interfering with or disrupting the Service or servers or networks connected to the Service.
  5. Data Mining: Using any robot, spider, or other automated means to access the Service for any purpose without our express written permission.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Konstrakt and its licensors. The Service is protected by copyright, trademark, and other laws of the Republic of the Philippines and foreign countries.

7. Payments and Fees

  • Fees: Some services may be subject to fees. All fees are in Philippine Peso (PHP) unless otherwise stated.
  • Taxes: You are responsible for paying all applicable taxes associated with your use of the Service.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Konstrakt, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  1. Your access to or use of or inability to access or use the Service;
  2. Any conduct or content of any third party on the Service;
  3. Any content obtained from the Service; and
  4. Unauthorized access, use, or alteration of your transmissions or content.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be settled in the courts of Metro Manila, Philippines.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
